Terms of Service

By purchasing, activating, or using Microchip (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter a binding contract. You are responsible for making sure your use of the Service is legal where you live.

2. What the Service is

Microchip provides access to an AI model that is intentionally offered with fewer content restrictions than typical AI products. Because of this, outputs may be inaccurate, offensive, disturbing, or unsuitable. You use the Service knowingly and at your own discretion.

3. Your responsibility for what you create

You are solely responsible for the prompts, files, and other inputs you submit, for the outputs you generate, and for how you use, share, publish, or rely on those outputs. We do not review, endorse, or control user-generated content, and we are not responsible for it.

4. Prohibited uses

An unrestricted model does not mean unrestricted legal permission. You may not use the Service to:

create, request, or distribute sexual content involving minors, or any content that sexualizes minors;
threaten, harass, stalk, dox, or defraud any person, or generate non-consensual intimate imagery or impersonation of real people intended to deceive or harm;
plan or carry out violence, terrorism, or other serious crimes, or build weapons capable of mass harm;
develop or deploy malware, or attack systems you do not have permission to test;
violate any applicable law or the rights of others, including intellectual property and privacy rights;
resell, share, or publicly leak your access key, or attempt to bypass usage limits, scrape, or reverse engineer the Service.

We may suspend or terminate access, without refund, for violations, and we may cooperate with law enforcement where legally required.

5. Plans, payments, and refunds

Access is sold through plans shown on our site and processed by a third-party payment provider. Plan limits (for example chat caps and duration) are described at purchase. Because access is a digital product that is activated after purchase, all sales are final and non-refundable, except where a refund is required by applicable law. "Lifetime" means the lifetime of the Service, not of the user, and not guaranteed if the Service is discontinued.

6. Disclaimer of warranties

The Service and all outputs are provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, reliability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that outputs are safe, lawful, factual, or appropriate for any use.

7. Limitation of liability

To the maximum extent permitted by law, Microchip and its owners, operators, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from content users create, request, share, or rely on through the Service, or from use of or inability to use the Service. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

8. Indemnification

You agree to defend and indemnify Microchip and its operators against claims, damages, and costs (including reasonable legal fees) arising from your content, your use of outputs, or your breach of these Terms or the law.

9. Availability and changes

We may modify, limit, or discontinue any part of the Service, and update these Terms at any time. Continued use after an update means you accept it. We will change the effective date above when we do.

10. Governing law and disputes

These Terms are governed by the laws of the United States of America. Disputes will be resolved in the courts of a court of competent jurisdiction in the United States.

This policy explains what information Microchip collects, why, and the choices you have.

1. Information we collect

Purchase information: your email address and order details. Payments are handled by our payment provider (Shoppy), and we do not receive or store your full card or payment credentials.
Access information: your access key, plan, and activation or expiry dates.
Content you submit: prompts, messages, and uploaded images or files, and the outputs generated for you. Content may be processed and temporarily stored as needed to provide the Service, enforce plan limits, and investigate abuse.
Technical data: IP address, browser and device type, timestamps, and usage counts, used for security, abuse prevention, and enforcing plan limits.

2. How we use it

to deliver the Service, activate access, and apply plan limits;
to provide support and communicate about your order;
to detect fraud, abuse, and violations of our Terms, and to keep the Service secure;
to meet legal obligations.

We do not sell your personal information.

3. Who we share it with

Service providers that help us operate: payment processing, hosting, and the infrastructure that runs the model (currently Shoppy for payments, plus hosting and AI infrastructure providers).
Legal and safety: when required by law, court order, or to protect users and the public, including reporting illegal content where required.
Business transfers: if the Service is sold or merged, your information may transfer to the new owner.

4. Retention

We keep information only as long as needed for the purposes above, or as required by law. Order records may be kept longer for accounting and fraud prevention.
